 MagXmart is an ecommerce company, the corporate office of which is in Park Street, Kolkata.  MagXmart has recently started its e-commerce business in India. MagXmart terms itself as a website rather a market where users meet and interact with one another for their transactions.

Important terms and conditions


All commercial/contractual terms are offered by and agreed to between Buyers and Sellers alone. MagXmart does not have any control or does not determine or advise or in any way involve itself in the offering or acceptance of such commercial/contractual terms between the Buyers and Sellers.


MagXmart does not make any representation or Warranty such as quality, value, salability, etc. of the products or services proposed to be sold or offered to be sold or purchased on the Website. MagXmart does not implicitly or explicitly support or endorse the sale or purchase of any products or services on the Website. MagXmart has no liability for any errors or omissions, on behalf of third parties.

Breach of Contract:  

MagXmart is not responsible for any non-performance or breach of any contract, entered into between Buyers and Sellers. MagXmart does not guarantee that the concerned Buyers and/or Sellers will perform any transaction concluded on the Website. MagXmart shall not and is not required to mediate or resolve any dispute or disagreement between Buyers and Sellers.



 MagXmart does not give warranty as to the item-specifics (such as legal title, creditworthiness, identity, etc.) of any of its Users. MagXmart advises to independently verify the bona fides of any particular.

Right, Title or Interest over product:   

 MagXmart does not hold any right, title or interest, nor have any obligations or liabilities in respect of any contracts entered into between buyers and sellers. MagXmart does not take any responsibility for unsatisfactory or delayed performance of services or damages or delays as a result of products which are out of stock, unavailable or back ordered.

Bipartite contract:  

MagXmart is only providing a platform for communication and it is agreed that the contract for sale of any of the products shall be a strictly bipartite contract between the Seller and the Buyer.


The Terms and condition of MagXmart payment procedure are as follows:

Actual Delivery/ Physical Delivery indicates that the Goods / Products are handed over to the Buyer or to their Authorized Representatives by the logistic partner of MagXmart herein after the full payment of the consideration of such product takes place whether in Cash / or in Online mode whatsoever in nature and the Buyer agrees and gives its consent thereto without exhibiting any sort of demur.

 Constructive Delivery takes place when the person in possession of the goods acknowledges that he holds the Goods on behalf of the buyer after the buyer makes the payments to the MagXmart.

The delivery of the Goods / Products shall not be delivered to Buyer unless Full and Final Payments are being done by the Buyer.

MAG X MART will receive the payments from the Buyer directly and it will give intimation to the MagXmart team and MagXmart logistics partner namely Ecom Express. There-after the logistic partner of MagXmart namely Ecom Express will pick up the goods/products from the seller and will deliver such goods / products to Buyer’s Point.

Disputes (Resolutions) Policy

MagXmart has a Dispute Resolution process in order to resolve disputes between Buyers and Sellers.

Buyer Protection Programme

Situations where Buyer Protection Program Works:

  1. In case of a dispute where the Seller is unable to provide a replacement, MagXmart will actively work towards reaching a resolution.
  2. The Buyer can write to info@magxmart.com if the issue with the Seller is not resolved. MagXmart Customer Support team will look into the case to check for possible fraud and if the Buyer has been blacklisted/blocked from making purchases on the Website. Only after verifying these facts, a dispute can be registered.
  3. In due course of resolution, MagXmart Customer Support Team will facilitate a conference call including the Seller and the Buyer.



If you are a buyer then you are subject to following restrictions:

  1. There is a limitation period of 30 days in which the buyer has to file the complaint.
  2. The buyer can raise a dispute to MagXmart by writing an email to info@magxmrt.com
  3. Buyers are not entitled to immediate refund of money or replacement of the product. MagXmart will be first verifying the dispute and will be processing the claims that are valid and genuine.
  4. Buyers are requested not to initiate invalid or false claim or the buyer are requested not to provide incomplete or misleading information because MagXmart reserves right to initiate civil and/or criminal proceeding against the buyers in these cases.
  5. If there is a delay in shipment or delivery of the item then buyer cannot file a complaint or entertain any claim from MagXmart through this mechanism.
